LONG PAWS BOUTIQUE LTD TERMS AND CONDITIONS

1. Interpretation
1.1 In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

“Buyer” means the person who accepts a quotation or offer of the Seller for the sale of the Goods or whose order for the Goods is accepted by the Seller; “Contract” means the contract for the purchase and sale of the Goods which shall incorporate, and be subject to, these Terms and Conditions;

“Goods” means the goods (including any installment of the goods or any parts for them) which the Seller is to supply in accordance with the Contract;

 “Seller” means Long Paws Boutique Ltd ("Long Paws"), a company registered in England under 15296557 and includes all employees and agents of Long Paws Boutique Ltd, including www.longpaws.co.uk.


2. Delivery

    • 2.1 Delivery will have taken place once the Seller has delivered the Goods to the address specified in the Buyer’s order, or the Seller has notified the buyer, in writing, of the Goods being available for collection at the Seller’s premises.
    • 2.2 The Delivery Date is approximate only and time for delivery shall not be of the essence unless previously agreed by the Seller in writing. The Goods may be delivered by the Seller in advance of the Delivery Date upon giving reasonable notice to the Buyer.
    • 2.3 Where the Goods are to be delivered in installments, each delivery shall constitute a separate contract and failure by the Seller to deliver any one or more of the installments in accordance with these Terms and Conditions or any claim by the Buyer in respect of any one or more installments shall not entitle the Buyer to treat the Contract as a whole as repudiated.
    • 2.4 If the Buyer fails to take delivery of the Goods or any part of them on the Delivery Date and/or fails to provide any instructions to enable the Goods to be delivered on that date, the Seller shall be entitled to cancel the sale.
    • 2.5 We deliver within the UK using Royal Mail (or UK courier where required), and may require a signature on delivery. We aim to dispatch within two working days of receiving your order and having received cleared payment. Collars and Leads may take up to twelve working days to dispatch.
    • 2.6 The cost of delivery (where applicable) will be added to your order total before payment is charged. Overseas delivery charges will be quoted individually.
    • 2.7 If we are unable to perform the whole or part of the order due to any cause or event beyond our control we may by notice in writing to you cancel or suspend the order in whole or in part without liability. We may deliver separately the Goods which make up your order. Where we do so, you will only incur one delivery charge.
3. Risk and Retention of Title
  • 3.1 Risk of damage to or loss of the Goods shall pass to the Buyer at:
    • 3.1.1  the time when the Seller notifies the Buyer that the Goods are available for collection; or
    • 3.1.2 the time of delivery to the delivery address notified.
  • 3.2  Notwithstanding delivery and the passing of risk in the Goods, or any other provision of these Terms and Conditions, legal and beneficial title of the Goods shall not pass to the Buyer until the Seller has received in cash or cleared funds payment in full of the Selling Price of the Goods including any delivery charges.

4. Returns and Refunds
  • 4.1  If the Buyer is not satisfied with any Goods purchased from the Seller, the Buyer may return the Goods to the Seller and obtain a refund of the Purchase Price of the returned Goods, provided:
    • 4.1.1  the Buyer informs the Seller of the decision to return the goods within 14 Calendar Days of delivery of the Goods; and
    • 4.1.2  the Goods are returned to the Seller within 7 days of notifying the Seller of the decision to return them; and
    • 4.1.3  the Goods are returned in their original unopened condition and have not be used in any way.
  • 4.2  While the Goods remain in the Buyer’s possession the Buyer is under a duty to ensure that the Goods are kept safe and secure.
  • 4.3  The cost of returning the goods to the Seller shall be borne in full by the Buyer, and any damage occurring to the Goods during transit shall be borne by the Buyer.
  • 4.4  The original cost of delivery / shipping is not refundable.
  • 4.5  Where the Goods are custom made to the order of the Buyer, the Buyer shall not be entitled to return the Goods and receive a refund unless the Goods are faulty. The statutory rights of the Buyer are unaffected.
  • 4.6  The goods must be returned:
    • 4.6.1  to Long Paws, Suite 10, 220 The vale, London NW11 8SR; United Kingdom and
    • 4.6.2  with an original or a copy of the original receipt of purchase; and
    • 4.6.3  must be sent by recorded mail / courier; and
    • 4.6.4  must be packaged securely so as to ensure the Goods are not likely to be damaged in transit.
        5. Guarantees
        The Seller provides no additional guarantees.

        6. Consumer Rights
        The provisions of these Terms and Conditions are in addition to and do not affect the Buyer’s statutory rights as a consumer.

        7. Law and Jurisdiction
        • 7.1  These Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales.

        • 7.2  Any dispute, controversy, proceedings or claim between the Parties relating to these Terms and Conditions or to the Contract (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of England and Wales.
